Terms of service

Welcome to Empire Rust, a community-run Rust server. By accessing, playing on, or making any purchases related to our server (including through our store, website, or associated services), you agree to be bound by these Terms of Service ("TOS"). If you do not agree, do not use our services.

1. General Terms

  • Empire Rust is an unofficial, community-operated server for the game Rust, developed by Facepunch Studios. We are not affiliated with, endorsed by, or connected to Facepunch Studios Ltd. or any of its affiliates.
  • You must comply with the official Rust Terms of Service and guidelines from Facepunch Studios (available at facepunch.com/legal), in addition to our server rules and this TOS.
  • We reserve the right to modify these TOS at any time. Changes will be posted on our website or Discord. Your continued use of the server constitutes acceptance of the updated terms.
  • Services are provided "as is" and "as available." We do not guarantee uninterrupted access, error-free operation, or that the server will always be online. We may perform maintenance, wipes, or shutdowns without notice.

2. Purchases and Virtual Items

  • All payments made through our store (e.g., for ranks, kits, items, or perks) are final and non-refundable, except where strictly required by applicable law (e.g., certain consumer rights in the EU).
  • No refunds will be issued for any reason, including but not limited to: dissatisfaction, bans, server changes, wipes, downtime, or accidental purchases.
  • Purchased items, ranks, or perks are virtual goods with no real-world value. They represent a limited, revocable, non-transferable license to use certain features on our server only.
  • Virtual items have no monetary value outside the server and cannot be exchanged, sold, or transferred for real currency or other value.
  • We reserve the right to modify, remove, or revoke any purchased virtual items, ranks, or perks at any time, for any reason, including but not limited to:
    • Violations of this TOS or server rules.
    • Game balance changes, server wipes, or updates.
    • Technical issues or exploits.
  • If the server ceases operation, all virtual items and perks are forfeited with no compensation.
  • Purchases are not donations; they are payments for limited virtual licenses.

3. Chargebacks and Disputes

  • Initiating a chargeback, payment dispute, or reversal through your bank, PayPal, or any payment provider will result in an immediate and permanent ban from the server, Discord, and all associated services.
  • We will pursue recovery of any reversed funds and associated fees.

4. Bans and Enforcement

  • We reserve the right to ban, mute, kick, or restrict any player at our sole discretion, with or without warning or reason provided.
  • Common reasons for bans include cheating, toxicity, rule violations, exploits, or behavior detrimental to the community.
  • Bans may result in loss of all virtual items, ranks, and access, with no refunds.
  • No appeals are guaranteed, and decisions are final.

5. Privacy and Personal Information

  • We will NEVER sell, share, or disclose your personal information (e.g., payment details, email, IP address) to third parties, except as required by law or to process payments through trusted providers (who have their own privacy policies).
  • Information collected is used solely for server operation, purchase fulfillment, and enforcement.

6. Limitation of Liability

  •  Empire Rust and its operators are not liable for any damages, losses, or issues arising from use of the server, including data loss, downtime, lost virtual items, or third-party actions.
  • We are not responsible for actions of other players, hacks, or external factors.
